In addressing such claims, we have appeared before all levels of Court in Newfoundland and Labrador, including the Supreme Court of Newfoundland and Labrador, Trial Division and the Court of Appeal. We have also taken these cases to the Supreme Court of Canada. The widely publicized decision rendered by the Supreme Court of Canada in John Doe v. Bennett, [2004] S.C.J. No. 17 deals with the principles of vicarious liability and is a judgment highly favourable to our clients.

We understand that these claims are “different” simply because of the nature of the allegations being made. We handle these claims in a sensitive manner that recognizes your right to privacy and confidentiality. When possible, we often identify our clients simply as “John Doe” or “Jane Doe” as a means of protecting their identities.
