Talking to a lawyer about drafting a will or issues planning the division of an estate can be very difficult. Often clients feel uncomfortable discussing such private and personal issues. We understand that this is a sensitive area of law, and life, and we do our best to help our clients feel at ease.

We regularly draft wills for our clients. In doing so, we work with our clients to ensure that they understand how their estates are being divided, how their wills take effect after death, and the various roles and responsibilities of other people involved in the administration of their estates. For example, we will work with you to ensure that you have identified all of the assets to be included in your will. We will explain to you the probate process, which gives the will legal effect after death, and the roles of the executor, guardian, trustee and beneficiary.

Other estate planning tools include the Power of Attorney and the Advanced Health Care Directive. Under a Power of Attorney, you may appoint another person to assist with certain estate planning matters, which can be carried out prior to death. For example, you can authorize another person to conduct a property transaction, which may help deal with one of your assets.

The Advanced Health Care Directive allows you to set out your instructions or general wishes regarding your health care treatment and/or to appoint another person to be your substitute decision-maker. This is an important estate-planning tool for many people, especially if you wish to make arrangements for yourself in the event of your subsequent mental or physical incapacity.
